1. DEFINITIONS

"The Zone Neston", "we", "us" or "our" refers to The Zone Neston, of Survival House, Clayhill Industrial Estate, Neston, Cheshire, CH64 3RU. "You" or "your" refers to any person using this website, applying for or holding membership, or attending the facility as a member, guest, or visitor. "Facility" refers to any premises operated by The Zone Neston. "Membership" refers to any paid or complimentary arrangement permitting you to access the Facility and its services.

2. MEMBERSHIP

Membership of The Zone Neston is subject to acceptance of these Terms and completion of any required registration process, including a health and fitness questionnaire (PAR-Q) or similar declaration. The Zone Neston reserves the right to refuse or cancel membership at its discretion, including where a member fails to meet minimum age requirements, provides false information, or where accepting or continuing membership would not be in the best interests of The Zone Neston, its staff or other members.

Membership is personal to the individual named on the account and is not transferable to another person without the prior written consent of The Zone Neston.

Members under the age of 16 may only use the Facility under the direct supervision of a parent or guardian, or as otherwise agreed in writing by The Zone Neston.

3. FEES AND PAYMENT

Membership fees, class fees, and any other charges are payable in advance in accordance with the payment schedule agreed at the time of joining. Where membership fees are collected by recurring payment (such as Direct Debit or continuous card authority), you authorise The Zone Neston and its payment processing partners to collect payment on the agreed dates.

The Zone Neston reserves the right to change membership and class fees from time to time. Members will be given reasonable notice, generally not less than 30 days, of any increase in fees prior to it taking effect.

Failure to make payment when due may result in suspension or termination of membership, and any outstanding fees will remain due and payable. Where a payment fails or is returned unpaid, The Zone Neston reserves the right to charge a reasonable administration fee to cover costs incurred.

4. CANCELLATIONS AND COOLING-OFF PERIOD

Where you enter into a membership agreement with The Zone Neston online, by telephone, or otherwise off-premises, you may have a statutory right to cancel that agreement within 14 days of purchase without giving a reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, please contact The Zone Neston using the details set out in Section 15.

Outside of any statutory cooling-off period, cancellation of an ongoing membership requires the notice period set out in your membership agreement, which will generally be no more than one calendar month. Notice must be given in writing to The Zone Neston using the contact details in Section 15.

5. CLASS BOOKINGS

Classes and sessions may be booked in advance via the website, booking app, or in person, subject to availability. The Zone Neston operates a cancellation policy for booked classes; members who fail to attend a booked class or cancel with insufficient notice may be recorded as a "no show" and, where applicable, may be charged a no-show fee or have their booking privileges temporarily restricted.

The Zone Neston reserves the right to amend, cancel, or substitute any class, instructor, or timetable slot where reasonably necessary, including due to instructor unavailability or insufficient demand.

6. FACILITY RULES AND CONDUCT

All members and visitors must comply with the facility rules displayed on-site and any reasonable instructions given by The Zone Neston staff, including instructions relating to the use of equipment, hygiene, and appropriate footwear and clothing.

Members and visitors are expected to behave in a considerate and respectful manner towards other members, visitors, and staff at all times. The Zone Neston reserves the right to suspend or terminate the membership of, or refuse entry to, any individual who behaves in an abusive, threatening, or disruptive manner, or who otherwise breaches these Terms or the facility rules.

7. HEALTH AND SAFETY

You confirm that you are in good health and physically capable of undertaking exercise and activities offered at the Facility. If you have any pre-existing medical condition, injury, or concern that may affect your ability to exercise safely, you must seek advice from a qualified medical practitioner before using the Facility and must inform The Zone Neston staff prior to participating in any class or activity.

The Zone Neston reserves the right to request that you complete or update a health declaration form from time to time, and to refuse or restrict access to certain classes or equipment where reasonably necessary for your safety or the safety of others.

8. ASSUMPTION OF RISK AND LIABILITY

Exercise and physical activity carry an inherent risk of injury. By using the Facility, you acknowledge and accept this risk. The Zone Neston will take reasonable care to ensure the Facility and equipment are safe and properly maintained, and that instructors are appropriately qualified.

Nothing in these Terms excludes or limits The Zone Neston's liability for death or personal injury caused by its negligence, for fraud, or for any other liability which cannot be excluded or limited under applicable law. Subject to this, The Zone Neston shall not be liable for any indirect or consequential loss, or for any injury or loss arising from your failure to follow instructions, misuse of equipment, or pre-existing medical conditions not disclosed to The Zone Neston.

9. PERSONAL BELONGINGS

The Zone Neston does not accept responsibility for the loss, theft, or damage of personal belongings brought onto the premises, except where such loss or damage is caused by the negligence of The Zone Neston or its staff. Members and visitors are advised not to bring valuable items to the Facility and to use lockers where provided.

10. SUSPENSION AND TERMINATION OF MEMBERSHIP

Members may request a temporary suspension of membership (for example, due to injury, pregnancy, or extended travel) subject to the terms of their membership agreement and any supporting evidence reasonably requested by The Zone Neston.

The Zone Neston reserves the right to suspend or terminate any membership with immediate effect, without refund, in the event of a serious or repeated breach of these Terms, non-payment of fees, or conduct that The Zone Neston reasonably considers to be harmful to the Facility, its staff, or other members.

11. WEBSITE USE AND INTELLECTUAL PROPERTY

All content on this website, including text, graphics, logos, and images, is the property of The Zone Neston or its licensors and is protected by copyright and other intellectual property laws. You may view and print content from this website for your own personal, non-commercial use, but may not reproduce, distribute, or otherwise use any content without the prior written consent of The Zone Neston.

You agree not to misuse this website by knowingly introducing viruses or other malicious material, or by attempting to gain unauthorised access to the website, the server on which it is hosted, or any connected system.

12. PRIVACY

The Zone Neston processes personal information in accordance with its Privacy Policy, which is available on this website and forms part of these Terms.

13. CHANGES TO THESE TERMS

The Zone Neston may update these Terms from time to time to reflect changes in its services, facilities, or legal requirements. Where changes are material, The Zone Neston will endeavour to provide reasonable notice to members. The most up to date version of these Terms will always be available on this website.

14. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of England and Wales, and any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
